1MDB seeks Federal Court ruling, says Malaysia should hear fraud claims against UK law firm

1Malaysia Development Berhad (1MDB) has filed an application to appeal the appellate court's ruling that the High Court lacked jurisdiction to hear its lawsuit against a UK law firm, White & Case. Lawyer Lim Zhi Ying, representing 1MDB, confirmed the notice of motion was filed on August 28, and the Federal Court has fixed October 12 to hear the leave to appeal application.

The application seeks leave to appeal the Court of Appeal's decision, seeking answers to 24 questions of law concerning jurisdiction and consolidation of the suit. One of the questions is whether the relevant connecting factors for determining the forum conveniens should be assessed by reference to the entire conspiracy, including the locations of the alleged conspirators and material witnesses, rather than just the circumstances of the particular foreign defendant challenging jurisdiction.
