This new directive from the Departments of Labor, Homeland Security, and State requires agencies to consider an employer's recent or planned layoffs when processing H-1B labor condition applications, petitions, visas, and requests for entry into the United States.

The order does not automatically disqualify employers from sponsoring H-1B workers after layoffs, but it does require agencies to take layoffs into account when evaluating H-1B cases. This means that employers must be aware that their layoff plans could impact the H-1B processing of their foreign hires. Existing H-1B rules already safeguard American workers from displacement due to employer actions, and this new order expands the scope of scrutiny to include both past and future layoffs.

The Department of Labor will review labor condition applications within 30 days of the order, potentially affecting not just new H-1B applications but also earlier filings.
