UCC Enters UP Election Debate, But Timeline For Law Before Polls Remains Uncertain

Lucknow: Union Home Minister Amit Shah recently announced that the Uniform Civil Code (UCC) will be enacted in all 21 BJP-led NDA states prior to the 2029 Lok Sabha polls, reigniting the contentious debate in Uttar Pradesh just five months before the Assembly elections. Shah's announcement came on September 13 in Mumbai, stating that the NDA governments would introduce the UCC before 2029.

Presently, Uttarakhand is the only state with a UCC, while Gujarat, Assam, and Madhya Pradesh have passed legislation awaiting presidential approval. For Uttar Pradesh, the key question now is whether the Yogi Adityanath government will push for legislation before the 2027 Assembly election or keep the matter primarily in the political campaign.

The BJP has historically regarded the UCC as a core ideological commitment, alongside the Ram temple construction in Ayodhya and the abrogation of Article 370. The issue was also prominently featured in the BJP's 2024 Lok Sabha election manifesto. However, the political dynamics are shifting, as the BJP and the Samajwadi Party are gearing up for a contest focused on caste equations, the PDA formula, youth concerns, jobs, law and order, and Hindutva.

The BJP's spokesman, Dinesh Pratap Singh, affirmed the party's commitment to the UCC, citing its long-standing position within the party's election manifestos. Conversely, the opposition, particularly the SP, is leveraging the issue to challenge the BJP, arguing that it serves as a distraction from more pressing public concerns and links it to unemployment and economic challenges.

The drafting process for the UCC remains uncertain, as no request has been received from the Uttar Pradesh government to the State Law Commission to prepare a draft. Despite the potential complexities arising from exemptions and safeguards for Scheduled Tribes and customary practices, the prospect of enacting a UCC before the Assembly election remains in question.
