More than 21 content distributors slapped with heavy fines due to non-compliance

The Film and Publication Board (FPB) in South Africa has fined 21 content distributors for non-compliance, totaling R16.175 million. The fines vary from R150,000 for distributing films and games without proper registration to R750,000 for distributing unclassified adult films or failing to get a license for adult premises distribution.

Makhosazana Lindhorst, the acting Chief Executive Officer of FPB, emphasized during a conference in Fourways that the fines aim to enforce the regulatory responsibilities under the Films and Publications Act 65 of 1996. The Act requires distributors to register, submit films and games for classification, and self-classify. Inspections by compliance officers can detect non-compliance, leading to warnings and a 30-day correction period.

When non-compliance persists, the matter is referred to the Enforcement Committee, which can impose fines and suspend registrations. Lindhorst highlighted that the enforcement is not targeted at any specific content or industry but aims to ensure compliance with the law. The fines underscore the importance of informed consumer choices, particularly in protecting children from inappropriate content.

To avoid fines, Lindhorst warned that distributors must know their obligations, register, and ensure content is classified or self-classified. Accessing unclassified films or games could expose children and others in their care to harmful material. Therefore, she advised always checking the classification before viewing or allowing children access to such content.
