FSSAI takes action against Nestle for 'false' baby food tags

The Food Safety and Standards Authority of India (FSSAI) has taken legal action against Nestle India for promoting three infant nutrition products, claiming non-compliance. The regulatory body filed three adjudication cases against Nestle India's Unit I and Unit II over promotional material for NAN Excella Pro Stage 1 and Lactogen Pro 1.

The former product's advertisement claimed 5 HMOs and whey protein, while the latter stated its whey protein was easy to digest. Similarly, a follow-up formula's biotin content was also found to be below the prescribed levels during laboratory testing, which is a violation of the 2020 infant nutrition regulations. Nestle India has contested the claims, stating its products adhere to all regulations and are backed by scientific literature.

The regulatory body argues that the promotional claims breach Regulation 4(2) of the Food Safety and Standards (Foods for Infant Nutrition) Regulations, 2020 and Section 3 of the Infant Milk Substitutes, Feeding Bottles and Infant Foods Act, 1992.
