Dentist ‘failed’ to explain root canal risks: Delhi woman gets Rs 2 lakh payout

A Delhi consumer commission has ordered a dentist to pay Rs 2 lakh to a woman for inadequate dental care, alleging he did not fully disclose the root canal procedure, its risks, and alternatives, and did not acquire informed consent. The woman, who had initially paid Rs 1.10 lakh for the treatment in 2023, later had to pay Rs 1.38 lakh for corrective work at another clinic due to ongoing pain and discomfort.

The woman and her husband, a doctor, visited the dentist on August 9, 2023, seeking treatment for oral pain. They were informed they needed root canal treatment, dental crowns for four teeth and veneers for two teeth, but the woman claimed that the treatment could have been managed with less invasive methods. She alleged that the root canal was performed without anesthesia or written consent, and she was not given information about the risks, benefits, alternatives, and potential complications of the dental treatment, including the removal of tooth structure and root canal treatment.

The woman also claimed the dentist's behavior was disrespectful, making personal remarks about her complexion, and did not address her pain during the procedure. Despite the treatment, she experienced severe tooth and gum pain, making it difficult to eat and chew, and damaging her oral health. She later moved to another clinic for corrective treatment.

The dentist argued that he discussed the procedure, risks, benefits, alternatives, and complications with the woman and her husband, who eventually agreed to proceed with the treatment. The dentist claimed she was given anesthesia for the root canal treatment and informed her about the risks, benefits, alternatives, and potential complications multiple times.

The commission found that the dentist failed to obtain informed consent and provided documentary evidence of her agreement to the crown's shade and shape. The commission ordered the dentist to pay the woman Rs 2 lakh, including litigation costs, for failing to explain the procedure and obtain informed consent within three months.
