Exco can’t supersede Negeri Sembilan constitution, says undang

Rembau undang Hassan Ab Hamid has rejected a statement from Negeri Sembilan executive council members declaring the removal of Tuanku Muhriz Tuanku Munawir as the state's ruler. Hassan asserts that the core issue is whether the four initial undangs conducted an investigation into misconduct that warranted his removal. The Dewan Keadilan dan Undang (DKU) maintains that no investigation took place and that Tuanku Muhriz was neither notified nor given a chance to respond.

The DKU's decisions on customary matters are final and cannot be challenged in court, rendering the state exco unable to ignore its decision. Three of the four undangs who signed the proclamation were not in their stated positions at the time, according to the DKU. Additionally, the latest proclamation issued by Menteri Besar Ismail Lasim is disputed by Ismail himself, who claims it was invalid and signed under coercion.

While the exco has specific functions and jurisdiction within the state government, it cannot replace or avoid a process mandated by the Negeri Sembilan constitution through a collective decision or press release. All parties must respect the state constitution, the DKU's authority, and the decisions made by the DKU within its jurisdiction.

No individual, administrative institution, or exco meeting can supersede the Negeri Sembilan constitution.
