PM: Decision to defer Najib’s pardon petition based on law, not personal prejudice

On September 15, Prime Minister Anwar Ibrahim announced that the decision to defer former Prime Minister Najib Razak's petition for a royal pardon was made strictly based on the Federal Constitution, the rule of law, and official legal advice. Anwar emphasized that his role in the Pardons Board proceedings was strictly regulated by statute and legal guidance from the Attorney-General.

He stated that while a prime minister should have the ability to voice their opinions, they should do so in line with legal advice and the established rules. However, he also acknowledged that the final decision rested with the Yang di-Pertuan Agong (King of Malaysia), who must take into account all relevant factors during the Pardons Board meeting.

Anwar urged against viewing the question of Najib's pardon through a personal lens, instead advocating for an evaluation based on established legal standards and good governance. He firmly stated that his duty as prime minister was to submit to the principle of the rule of law and the constitution, and that he never adopted a prejudiced or hateful stance.

He also mentioned that political representations, including strong appeals from Umno leaders, were considered, but he chose to fulfill his constitutional duties by adhering to the principles of law and the spirit of governance in the country.

The decision to defer Najib's pardon petition was disclosed on September 11, following the 63rd Pardons Board Meeting for the Federal Territories of Kuala Lumpur, Labuan, and Putrajaya at Istana Negara. In December 2022, Najib was sentenced to 15 years in prison and fined RM11.4 billion for abuse of power and money laundering, involving RM2.3 billion misappropriated from the 1MDB funds.
