Former construction manager claims trial over RM14,000 CBT involving Tabung Haji project

Kota Bharu, September 15 — Mohamad Hashim Mukhatap, a 53-year-old former construction project manager, appeared in the Sessions Court today, not guilty to charges of criminal breach of trust (CBT) related to RM14,000 collected from a contractor for a commercial building project. The funds, seized as penalties from Kelpile Sdn Bhd, were allegedly misappropriated by Mukhatap by being placed into his personal bank account.

The case centers around a 22-storey commercial building project in Kota Bharu, comprising serviced apartments, penthouses, public amenities, and commercial space. The alleged offense transpired between November 15, 2017, and August 8, 2018, at Sofea Residensi, Lot 10015, Section 12. Conviction under Section 409 of the Penal Code entails a maximum of 20 years' imprisonment, whipping, and a fine.

The Malaysian Anti-Corruption Commission (MACC) Deputy Public Prosecutor, Mariah Omar, sought bail of RM15,000, while Mukhatap's defense lawyer, Fahmi Abd Moin Khairuddin, proposed RM5,000. Judge Dazuki Ali granted bail of RM8,000 with one surety, instructing Mukhatap to surrender his passport, avoid interfering with witnesses, and report to MACC Shah Alam monthly. The court set October 19 for the next mention.
