Fannie Nkosi intends making representation to DPP over his charges

Sergeant Fannie Nkosi, currently held in custody, has expressed his intention to submit written representations to the Director of Public Prosecutions, seeking to have all charges against him reconsidered. During a recent court appearance in August, the magistrate postponed the case, allowing the prosecution to disclose the contents of the dockets to Nkosi's defense.

The defense team was subsequently provided with the materials, but the case was postponed once more after Nkosi indicated his desire to challenge the charges against him.

In a conversation with the court, Nkosi's legal team confirmed that they have commenced drafting the representations, with the intention of submitting them within the next two weeks. As a result, the court has once again postponed the matter until the outcome of the representations can be determined.

Nkosi remains in custody, as the High Court in Pretoria has previously dismissed his bail application. The magistrate's court ruled that Nkosi had not sufficiently demonstrated that he would not pose a danger to others, evade prosecution, or interfere with the investigation and witnesses. Madlanga Commission of Inquiry task team arrested Nkosi on April 2nd, following his testimony before the commission and a search of his home in Pretoria.

In addition to the original charges, the Madlanga Commission of Inquiry's Recommendations Investigative Task Team brought further charges of defeating and obstructing the course of justice against Nkosi. The prosecution alleges that, on November 10th, 2022, a suspect was apprehended for possession of dagga, unlicensed firearms, and explosives.

Nkosi allegedly retrieved the original case docket under the guise of a request from the head office. A few months later, he returned to Thohoyandou, introduced himself as a colonel from head office, and removed the confiscated dagga from police custody, booking it at the head office. However, it later emerged that one of the exhibit bags containing the dagga had been tampered with.

Nkosi has consistently denied all charges against him, asserting that the state's case is weak. The court has postponed the case to October 15th, 2026.
