Constitution must remain supreme, every exercise of public authority must be within its limits: FCC CJ

Chief Justice Aminuddin Khan of the Federal Constitutional Court (FCC) emphasized the importance of constitutional supremacy during a recent event in Islamabad. He stressed that every exercise of public authority must remain within the constitutional boundaries and that the Constitution is "the supreme expression of the collective will of the people".

The FCC, established under the 27th Constitutional Amendment passed in November 2025, serves as the country's highest judicial forum, and Justice Khan described its creation as "an important institutional development in the constitutional history of Pakistan".

Recalling the challenges faced during its establishment, Justice Khan stated that the FCC had to build its infrastructure while simultaneously performing its judicial responsibilities. He noted that the court began its work from scratch with no prior institutional preparation. In November 2026, the government relocated FCC judges from the Federal Shariat Court (FSC) building to the IHC premises, despite space constraints, as FSC judges had initially refused to vacate the building.

Justice Khan highlighted that despite physical limitations, the FCC's work has continued. He emphasized that institutions are built by people and commitments, rather than just concrete and bricks. The FCC now operates with nearly 400 officers, officials, and attached staff working within its premises, occupying a building originally designed to accommodate around 100 employees.
