China’s new tech, national security exit rules take effect

China has implemented new exit and entry rules aimed at safeguarding national technology security, taking effect on Tuesday. The measures specifically target individuals deemed potential threats to China's technological interests. Previously, senior Chinese officials and state executives with access to confidential information were subject to travel restrictions. However, these new rules expand the scope of exit bans to encompass a broader category of Chinese citizens.

The rules stipulate penalties ranging from six months to three years for those returning to China after committing illegal or criminal acts abroad that compromise national security or interests. Foreign nationals may also face entry denial for one to five years if they provide false information in their visa applications.

China has long practiced curbs on personal foreign travel for individuals with access to sensitive information. In 2023, Reuters reported that Chinese civil servants and employees of state-linked enterprises faced increased limits on private travel abroad and scrutiny of foreign connections as Beijing intensified its campaign against foreign influence.

The new rules have raised concerns among Taiwan, which Beijing considers its own territory. Taiwan's China-policy making Mainland Affairs Council warned its citizens to exercise caution when visiting China, as the new rules legalise previously legally unfounded border control practices and enhance the discretionary authority of enforcement agencies.

A deputy head of Taiwan's council emphasized the significance of the new language regarding export control and technology import-export management as grounds for restricting exit, particularly for Taiwanese working in the tech sector. Despite these concerns, China maintains that the rules provide enhanced legal protection for Taiwanese individuals.
