Can you be blacklisted for not serving notice period?

In India, employees cannot be compelled to serve their notice period under the law. Employers may pursue contractual remedies such as recovering notice pay or damages, but cannot legally blacklist or threaten terminated employees. Internal "do-not-rehire" flags are common and defensible. Employers cannot force an employee to work without completing their notice period, as Article 23 of the Constitution and Indian contract law prohibit coercive labor practices.

While an employer may send a legal notice or claim damages, obtaining a court order to prevent a former employee from joining a competitor is highly unlikely, as it would violate Section 27 of the Indian Contract Act, 1872, which restricts restrains of trade.
