THE LAW 101: Overhauling Lawyer Discipline – Why the Practitioners Standards Board Bill is long overdue

In a significant development for legal practice in Ghana, Attorney-General Dr. Dominic A. Ayine, speaking at the 2026 Ghana Bar Association Annual General Conference in Ada, introduced a proposed LEGAL PROFESSION (PRACTITIONERS STANDARDS BOARD) BILL. This long-awaited reform aims to address the fundamental structural flaws in Ghana's professional regulatory framework, particularly the Disciplinary Committee of the General Legal Council (GLC).

The proposed Bill is crucial for restoring due process and public confidence in the administration of justice. Among its key objectives are:

1. Separation of Investigatory and Adjudicative Functions: The current framework blurs the line between investigating complaints and adjudicating them. The Bill establishes an independent Disciplinary Committee with clear, time-bound rules of procedure, ensuring that complainants are informed of the allegations against them, have the opportunity to be heard, and are subject to proportionate sanctions.

2. Resolution of Structural Anomalies: Currently, Superior Court judges serve on the GLC’s Disciplinary Committee, creating a conflict of interest as their decisions are subject to judicial review. The proposed Board will be composed of lay non-lawyers and professional representatives with secured tenure, eliminating this discordant relationship.

3. Reduction of Unreasonable Delays: Disciplinary complaints often take years to resolve, leaving both complainants and lawyers in a state of professional uncertainty. The proposed Board will introduce strict procedural timelines for addressing grievances, ensuring a more timely resolution.

4. Protection Against Harassment: By separating professional discipline from executive, judicial, or competitive interference, the Bill ensures that the disciplinary machinery cannot be manipulated against practitioners by clients, rivals, the Bench, or the State. This is essential for maintaining an independent and self-governing Bar, built on procedural integrity.
