S’wak’s ‘rights’ claim no licence to weaken Petronas, Zaid tells Lau

The ongoing dispute between Petronas and Petroleum Sarawak Bhd (Petros) has reignited debate about Sarawak's constitutional claims to oil and gas resources. Senator Robert Lau argues that these claims are protected by the Malaysia Agreement 1963, the Federal Constitution, and the division of powers between federal and state governments over petroleum resources.

However, ex-minister Zaid Ibrahim contends that pursuing such claims could compromise Petronas's ability to fulfill its national role and safeguard the nation's energy security. Zaid emphasized that a claim to rights does not automatically justify altering the operating structure of Malaysia's energy system in a way that weakens Petronas's integrated model.

The central issue, he stated, is whether any political settlement would preserve Petronas's operational and commercial viability. The former law minister also clarified that the Petronas-Petros dispute is distinct from the Tabung Haji (TH) controversy, where allegations of corruption and mismanagement were present. He pointed out that the gas aggregator issue affects commercial arrangements, supply reliability, and Malaysia's energy security, and should not be dismissed solely as a political matter.

Zaid stressed that any new arrangement must be evaluated based on its operational and commercial consequences, rather than its political appeal. He highlighted that Sarawak's claim, while rooted in constitutional rights, requires legal interpretation and is not yet a settled entitlement. While Section 3 of the Petroleum Development Act 1974 may permit a political solution, Zaid cautioned against interpreting it as a free pass for concessions without considering the central question: whether the arrangement preserves Petronas's capacity to safeguard Malaysia's energy security and national interest.
