Rechtsstreit: Millionenstreit um Wiesn-Zelte – Gericht prüft EU-Vergabe

In Munich, a legal battle over the lucrative billion-dollar Oktoberfest tent business has reached the Bavarian Supreme Court regarding a request from brewer Alexander Egger. The courtroom proceedings revolve around the allocation of popular large Oktoberfest beer tents, with Egger demanding that they follow European procurement laws.

Egger, accompanied by five lawyers and a law professor, appeared in court requesting that the coveted tents be subjected to European competition rules. The court is deliberating on whether the granting of licenses for the prime locations constitutes a public service contract, which would require the inclusion of a duty for the licensed brewers.

However, the court has not yet made a final decision, stating that it must consider whether a European service contract obligation exists for the licensed brewers. This dispute has been raging for months, with brewers and representatives of Munich breweries warning that if Egger's request is granted, the Oktoberfest might lose its unique character.

The value at stake is estimated to be around one million euros if both tents are included, with an assumption of ten million euros in annual revenue per tent. The court's decision on the matter is expected on October 16th.
