UK Eases Visa Rules for Exploited Skilled Workers

The UK government has announced modifications to its immigration rules, intending to grant enhanced work flexibility to specific Skilled Worker visa holders who have been identified as victims of modern slavery. Under these revised regulations, Skilled Workers who have been referred to the UK’s National Referral Mechanism (NRM) and have received a positive Conclusive Grounds decision during their most recent immigration permission period may have their work conditions altered.

Upon such an amendment, eligible workers will be permitted to work outside the initial job for which they were sponsored, encompassing employment with another employer, becoming self-employed, or undertaking voluntary work during the remaining duration of their existing immigration permission. However, the new rules do not permit Skilled Workers to engage in professional sports or coaching.

This measure aims to benefit Skilled Worker visa holders who entered the UK legally but subsequently experienced exploitation. The existing sponsorship system generally confines Skilled Workers to the job and employer associated with their visa, posing challenges for exploited workers to leave their employment while maintaining legal work status.

The UK government suggests that this change is intended to diminish the likelihood of further exploitation and incentivize victims to report abuse at an earlier stage. Concurrently, authorities have intensified actions against employers found to be abusing the sponsorship system. The UK Visas and Immigration department has withdrawn over 7,500 sponsor licenses, including 1,800 operating within the care sector.

It is important to note that the new provision will not be applicable to all Skilled Worker visa holders. Instead, it is restricted to workers who have been referred to the NRM and have received a positive Conclusive Grounds decision during their latest period of immigration permission. The Skilled Worker provision will commence on October 8, 2026.
