Tensions flare as judge declines to remove juror in Lindsay Clancy trial

In the Lindsay Clancy murder trial, a lone juror's refusal to abide by the court's instructions to consider reasonable doubt has impeded the jury from reaching a unanimous verdict. The defense attorney, Kevin Reddington, made this claim in court on Thursday after the jury's deliberations spanned six days. Judge William Sullivan, presiding in Plymouth, Massachusetts, subsequently instructed the jurors to reconvene and continue their deliberations.

Reddington sought to have the holdout juror removed, citing the note from the foreperson indicating a juror's unwillingness to follow the court's guidance on reasonable doubt. Despite Reddington's efforts, the judge decided against removing the juror. The jury had previously expressed its inability to come to a unanimous decision on both Tuesday and the day prior.

If the jury fails to reach a verdict and the judge declares a mistrial, prosecutors would need to decide whether to retry the case, which involved over 80 witnesses and more than 300 exhibits. The defendant, Lindsay Clancy, faces a life sentence without parole if convicted of first-degree murder. If acquitted due to lack of criminal responsibility or insanity, she could be committed to a state psychiatric hospital for evaluation.

Clancy admitted to killing her three children—Cora, 5; Dawson, 3; and Callan, 8 months—by strangling them with exercise bands in their Duxbury home on January 24, 2023, and then attempting suicide by jumping from a second-story window, leaving her paralyzed. During the six-week trial, Reddington argued that Clancy was experiencing a psychotic episode at the time of the murders, suggesting she did not comprehend the wrongfulness of her actions and intentionally killed her children.

Prosecutors maintain that Clancy, a former labor and delivery nurse, was aware of the wrongfulness of her actions and deliberately chose to kill her children, believing that they would suffer without her.
