T.N. govt. allows shops, other establishments to remain open on all days for another three years

The Tamil Nadu government has extended by three years its exemption that permits all shops and other establishments to operate on every day of the year, according to a government order issued on August 24. The earlier exemption was granted in 2023. The extension aims to protect employees by mandating specific working conditions.

Each employee must receive one day off per week on a rotating basis, with the schedule clearly displayed at the workplace. Employers are also required to publicly announce which employees are on leave or have weekly holidays. Working hours are capped at eight hours a day or 48 hours per week, including overtime. The total working period cannot exceed 10.5 hours daily or 57 hours weekly.

Wages, including overtime, must be deposited directly into employees' bank accounts. The notification further emphasizes protective measures for female employees. They generally cannot be required to work after 8 p.m., though exceptions can be made with their consent and adequate safety arrangements. Employers must provide transportation for women working shifts and display notices about this facility at the main entrance.

Basic amenities such as restrooms, washrooms, safety lockers, and other necessary provisions must be available. Employers with female employees must also have a functioning Internal Complaints Committee to handle sexual harassment allegations at the workplace. The government warns that any violations of these conditions or other legal provisions will result in penalties under the Tamil Nadu Shops and Establishments Act, 1947, and related rules.
