IMPEACHMENT: Phala Phala court arguments put presidential accountability under scrutiny

The impeachment proceedings against President Cyril Ramaphosa, concerning his involvement in the Phala Phala farm saga, continue to raise questions about presidential accountability. The parliamentary impeachment committee has restarted its search for a new evidence leader after initially recommending advocate Thandazani Madonsela, who was subsequently dropped due to concerns about perceived conflicts of interest.

Madonsela had previously supervised a junior's brief to a "parliamentary study group" tied to the ANC, which was deemed relevant to the committee's terms of reference. The impeachment committee is currently interdicted from holding public hearings due to President Ramaphosa's successful court order, which is pending his review of the Section 89 panel report.

This review hearing, held in the High Court's Western Cape Division, addressed issues such as evidentiary thresholds, process, and potential reputational harm to the president. If Ramaphosa's review succeeds, it could further delay accountability, as argued by legal representatives from various political parties. The constitutional process of holding the president to account must maintain its integrity, according to one judge, while another emphasized that the impeachment motion and the Speaker's referral would still stand, allowing parliamentary accountability proceedings to continue.
