UK allows modern slavery victims on skilled worker visas to leave exploitative employers

The UK government has revised immigration rules to facilitate the departure of recognized modern slavery victims working under Skilled Worker visas from abusive employers, without forfeiting their immigration status. The Home Office announced the alteration on September 3, 2026, emphasizing its objective to prevent such individuals from being ensnared in exploitative employment due to visa constraints.

According to the Home Office, "No victim of modern slavery should be trapped with an exploitative employer because of their immigration status."

The amendment applies to Skilled Worker visa holders who have been identified as modern slavery victims by the Home Office's competent authorities. It permits these individuals to seek employment with any employer for the remainder of their existing visa validity, a departure from the typical restriction that prevents them from taking a new job if they cease working for their sponsoring employer.

The Home Office asserts that the new rule aims to incentivize victims to report abuse promptly, thereby enabling authorities to identify cases of exploitation more efficiently. Additionally, it seeks to deter potential exploitation by those seeking to exploit the sponsorship system for their own gain. The change became effective on the same day the Home Office posted the announcement on X, stating that the provision will "incentivise victims to come forward early" and contribute to the identification of exploitation cases.
