Bombay HC Stays Further BMC Action At Rustomjee Crown In Prabhadevi, Seeks Developer’s Reply

On September 3, 2026, the Bombay High Court issued an order urging the developer of Rustomjee Crown in Prabhadevi to respond to a legal challenge by flat owners against the Brihanmumbai Municipal Corporation's (BMC) demolition actions. The plaintiffs, representing approximately 140 apartment owners, are seeking damages totaling Rs 1,000 crore and an end to the ongoing demolition.

The suit was filed by 246 plaintiffs on behalf of affected flat owners. They are contesting the BMC's demolition initiated on August 24, which targeted foyers in Towers A, B, and C of the Rustomjee Crown complex. With Towers A and B being 53-storey buildings and Towers A and B housing apartments on each floor, the BMC has demolished eight foyers in five-bedroom apartments.

The plaintiffs claim that the BMC misrepresented the foyers as exclusive areas attached to individual apartments, which were separately highlighted in marketing materials, apartment plans, costing documents, and sale agreements. They assert that the purchase consideration, stamp duty, and registration charges were determined based on the combined area of the apartment and foyer.

According to the suit, the BMC had conducted inspections of Towers A and B before granting occupation certificates in 2025. However, when the developer sought an occupation certificate for Tower C, the BMC allegedly discovered that the foyer areas resulted in excess floor space index consumption. The plaintiffs are seeking Rs 1,000 crore in damages, a cancellation of the BMC notices, protection against demolition, and instructions to restore the foyer spaces.

In response to the demolition, the Rustomjee Group has denied any violation, stating that the construction complied with approved plans and received an occupation certificate. The developer is currently cooperating with the authorities.
