AG, OSP ‘FIGHT’ Over Cases

The relationship between the Office of the Attorney General (AG) and the Office of the Special Prosecutor (OSP) in Ghana appears to be deteriorating, with both institutions seemingly engaging in a power struggle. Despite claiming no issues, recent events suggest a more complex dynamic. Sammy Darko, Director of Strategy, Research and Communications at the OSP, revealed that the AG has rejected multiple requests for collaboration on national issues, which the OSP has made on several occasions.

However, Deputy Attorney General Dr. Justice Srem-Sai dismissed these claims as "a complete falsehood" and emphasized the AG's leadership role over the OSP. He argued that the OSP cannot request collaboration because it operates under the AG's authority, as affirmed by the Supreme Court. This power imbalance potentially complicates the relationship between the two agencies, creating a scenario where the OSP might face challenges in initiating criminal proceedings without AG authorization.

The Supreme Court's recent decision, while confirming the OSP's authority to prosecute corruption cases, also placed the OSP under the Attorney General's supervision, potentially exacerbating tensions between the two offices.
