Supreme Court to rule on SkyTrain case today

The Supreme Court is set to rule on a dispute involving former Executive Director Solomon Asamoah and former Board Chairman Professor Christopher Ameyaw-Akumfi in a $2 million SkyTrain case. The two defendants have filed a motion seeking to invalidate a High Court ruling that dismissed their claims of no case to answer and ordered them to present their defenses.

They argue that the High Court made an error in directing them to defend themselves after determining that the prosecution had established a prima facie case against them. On July 30, the court granted a 21-day extension, and on August 24, they were scheduled for a case management conference, which they also failed to attend, resulting in another extension until September 23.

The prosecution alleges that the SkyTrain project lacked approval from the Ghana Infrastructure Investment Fund Board, leading to the filing of six counts against the defendants, including conspiracy to wilfully cause financial loss to the Republic and conspiracy to intentionally dissipate public funds. The defense counsel contends that the $2 million was an equity investment and that there is insufficient evidence to support the prosecution's case.
