IHC Issues Notices to Govt and PTA on Social Media Ban Petition

The Islamabad High Court (IHC) recently issued formal notices to several government ministries regarding a petition demanding a ban on social media access for individuals under the age of 16. The court also sought responses from the Pakistan Telecommunication Authority (PTA) and the Pakistan Electronic Media Regulatory Authority (PEMRA).

Chief Justice Sarfraz Dogar presided over the hearing, where the petitioner's legal representative argued that numerous countries have already implemented legislation aimed at safeguarding children's digital well-being. Examples mentioned included Australia, Indonesia, Malaysia, and Turkey, which have either enacted or enforced bans or registration restrictions for minors on social media platforms.

The legal counsel further contended that upholding the best interests of children is a fundamental constitutional and legal obligation for the state.

During the proceedings, the court inquired whether PEMRA currently possesses any specific legislation addressing this issue. The counsel responded that no such legislation has been enacted thus far, although PEMRA does have the authority to take action upon receiving complaints. The court then proceeded to issue notices to the various parties involved and requested their respective replies.
