Public varsities ordered to stop disciplinary proceedings over freedom of speech, assembly

The Malaysian higher education ministry has ordered all public universities to cease disciplinary actions against students regarding freedom of speech, public criticism, and peaceful assembly, effective immediately. According to a statement, several provisions under the Universities and University Colleges Act 1971 (Auku) and the Student Disciplinary Rules have been deemed exempt from enforcement.

These include students' rights to manage clubs and societies, organize student activities, communicate through platforms, and disseminate or publish documents. The ministry's decision comes in response to Prime Minister Anwar Ibrahim's call for universities to stop disciplinary proceedings against students exercising their rights to express views or criticize.

Anwar stated during a recent forum at Universiti Malaya that investigations should first halt at the university level, as repealing Auku would take time. However, the ministry stressed that these freedoms must coexist with responsibility and respect for the rule of law, while noting that acts involving violence, vandalism, property damage, criminal offenses, academic misconduct, or breaches of legitimate disciplinary rules will still be subject to applicable laws.

A similar review of provisions governing students at international universities not covered by Auku, such as Universiti Teknologi Mara, will also be carried out to ensure alignment with the reforms. Anwar revealed last week that the legislation to repeal Auku is expected to be introduced in the Dewan Rakyat this year.
