Adu-Boahene case: High Court judge rejects application by Atta Akyea to halt proceedings

In a recent High Court case, lawyers representing former National Signal Bureau Director Kwabena Adu-Boahene, represented by Samuel Atta Akyea, were instructed to continue with the trial after an attempt to halt it was unsuccessful. Akyea was seeking to postpone the proceedings until the review of the Supreme Court's decision on the injunction filed by Ofoase Ayirebi Member of Parliament was completed.

Adu-Boahene and his wife, Angela Adjei Boateng, are accused of stealing, causing financial loss to the state, using public funds, and money laundering. They have pleaded not guilty and are currently on bail. During a hearing on Tuesday, August 25, Akyea asked the court to adjourn the trial, citing that Kojo Oppong Nkrumah had submitted a repeat injunction application to a three-member panel of the Supreme Court on Monday, August 24, to review an earlier ruling that rejected his attempt to challenge the Chief Justice warrant issued to High Court judges during the legal vacation.

The application was set to be heard on September 2, and Akyea argued that it directly impacted the trial. However, Deputy Attorney General, Dr Justice Srem-Sai, opposed the prayer and advised the court to dismiss it. He claimed that the apex court had already decided the original injunction application regarding the legal vacation, thus a review request should not automatically suspend the proceedings.

After considering both sides, presiding judge Justice Francis Apanga Achibonga ruled that there was no requirement to suspend the trial in such situations. Consequently, he dismissed Akyea's prayer for adjournment and ordered him to proceed with the cross-examination of the prosecution's witness.
