Judge blocks Trump's immigrant visa suspension for 75 nations

U.S. District Judge Jeannette Vargas in Manhattan has invalidated a Trump administration policy that suspended the issuance of immigrant visas to applicants from 75 countries, deeming it "patently unlawful" and in violation of federal immigration law. The State Department's January announcement of the policy prohibited the issuance of immigrant visas based on the nationality of the applicant, directly contradicting the statutory scheme that explicitly stripped the Secretary of State of authority over consular officers' processing of immigrant visas.

Affected countries included Latin American nations like Brazil, Colombia, and Uruguay, as well as Balkan nations, South Asian countries such as Pakistan and Bangladesh, and nations from Africa, the Middle East, and the Caribbean. The State Department had argued that applicants from these countries posed a high risk of becoming public charges, relying on local, state, and federal government resources in the United States.

Vargas, appointed by former President Joe Biden, issued the ruling in a lawsuit filed by immigrant rights groups and individuals impacted by the policy. While the State Department did not immediately comment on the ruling, the policy was part of President Trump's efforts to enhance domestic security. Critics argue that the crackdown has violated free speech, due process rights, and created an unsafe environment, particularly for ethnic minorities, who raised concerns about racial profiling.
