Madhya Pradesh High Court restores government employee’s 50% pension

The Madhya Pradesh High Court has overturned a decision that withheld 50 percent of a government employee's pension. The court ruled that the disciplinary authority failed to consider the employee's detailed reply and issued a non-reasoned order. The court also quashed an appellate order rejecting the employee's appeal and directed the authority to reconsider his reply.

The employee had challenged the 50 percent pension withholding, which followed a departmental inquiry in which the charges against him were found proved. The court emphasized that a disciplinary authority exercising quasi-judicial powers must pass a reasoned and spoken order, considering all the facts and circumstances of the case and recording valid and justifiable reasons in support of its conclusion.
