Legal vacation: Deputy AG accuses Oppong Nkrumah of ‘deliberate falsehood’

Deputy Attorney General, Dr Justice Srem-Sai, has taken issue with MP Kojo Oppong Nkrumah and his legal representatives for claiming that their dispute over the Chief Justice's directive is a "deliberate falsehood." This statement came after the Supreme Court rejected Mr Oppong Nkrumah's request to halt criminal trials planned to take place during the ongoing legal vacation.

Justice Gabriel Pwamang, who presided over the case, dismissed the injunction on August 21, 2026, due to a lack of sufficient grounds for the court to grant the relief.

In a Facebook post following the ruling, Dr Srem-Sai alleged that the MP's case was based on the assertion that the Chief Justice had only authorized two judges to hear selected cases during the legal vacation. Dr Srem-Sai contended that this claim was contradicted by the evidence presented by the applicants. He specifically pointed to Exhibit D, which demonstrated that the Chief Justice's warrant was a general directive, not restricting judges to hearing only certain cases.

Additionally, Dr Srem-Sai cited Exhibit E, which showed that 29 judges were sitting during the legal vacation, not just two as the applicants claimed.

Despite these discrepancies, Dr Srem-Sai acknowledged that the legal challenge disrupted the normal functioning of the courts for a week. He emphasized that the defendants had managed to prevent the courts from operating for that period, underscoring the danger of spreading "deliberate falsehoods." Mr Oppong Nkrumah's main legal challenge, which questions the constitutional validity of the directive permitting certain High Court judges to continue hearing criminal cases during the legal vacation, remains unresolved.
