The company, represented by its director Foo Loke Hin, 57, was charged with three counts of providing a communication network without a valid Individual Communications Network Provider (NFP I) license and an Unlicensed Communication Network Service (NSP I) license, under Section 126(1)(a) and (b) of the Communications and Multimedia Act 1998.
Both sections carry penalties of up to RM1 million in fines or imprisonment for up to 10 years, or both, and a subsequent fine of RM100,000 for each day or part of a day the offense continues after the offense has ceased. Khairul Bakhri requested a low bail of around RM15,000 for both defendants due to their financial situation with two children, one of whom is still in university. They have cooperated fully throughout the investigation, and Fadhli requested the court to consider this factor.
Magistrate Noor Ruzilawati Mohd Nor granted a bail of RM60,000 for both defendants for all charges, subject to the additional condition imposed by the prosecutor, and set October 5 for the continuation of the hearing.
