Australian ‘mushroom killer’ Erin Patterson launches appeal against life sentence

Melbourne, Aug 19 — Erin Patterson, the 51-year-old Australian who was convicted in a triple-murder case, commenced an appeal on Wednesday against her life sentence. Patterson was found guilty in 2023 of murdering her husband's parents and an elderly aunt by serving them a beef Wellington lunch contaminated with death cap mushrooms.

She also faced charges of attempting to murder her husband's uncle, a local pastor who survived the meal after weeks in the hospital. A judge sentenced her to life imprisonment, with eligibility for parole after 33 years. The Court of Appeal in Melbourne is currently hearing two appeals - Patterson's attempt to overturn her conviction and the prosecution's request for a harsher sentence.

The trial took place over two days starting on Wednesday at Melbourne's Supreme Court, with Patterson appearing via live video link from her maximum-security jail. Patterson alleges that there were "substantial miscarriages of justice" in the trial, as the judge improperly decided which evidence could be presented. Her lawyer argues that certain evidence, including Facebook messages, cell tower data, and posts about death cap mushroom sightings, was unfairly prejudicial to her case and should have been excluded.

Additionally, the lawyer claims that a "fundamental irregularity" occurred while the jury was sequestered, which "fatally undermined" the integrity of the verdicts. The prosecution, on the other hand, argues that the 33-year non-parole period imposed by the judge was "manifestly inadequate" and that Patterson's chances of being held in solitary confinement for years were "substantial", which "infected" his decision.
