Australian court begins appeal hearing for mushroom murderer Erin Patterson

Melbourne: Erin Patterson, the 51-year-old Australian woman convicted of murdering her husband's parents and an elderly aunt with a death cap mushroom-laced beef Wellington, has commenced an appeal against her conviction and sentence. The triple-murder took place in 2023, drawing global attention. Patterson, who is serving a life sentence with parole eligibility after 33 years, argues that the trial judge made substantial errors in determining which evidence could be presented.

Her legal team contends that certain evidence, including Facebook messages, cell tower data, and mushroom sighting posts, was improperly admitted or unfairly prejudicial to her case. Additionally, Patterson alleges a fundamental irregularity occurred during the jury's sequestration, undermining the integrity of the verdicts. The prosecution, however, seeks a harsher sentence, arguing that the 33-year non-parole period is manifestly inadequate because the judge believed there was a substantial chance Patterson would be held in solitary confinement for years to come.

The Court of Appeal in Melbourne is hearing both Patterson's appeal to overturn her conviction and the prosecution's request for a stiffer sentence over a two-day period starting on Wednesday. Patterson appeared via live video link from her maximum-security jail, the Dame Phyllis Frost Centre, during the proceedings, wearing a blue prison jumper.
