Major Meta trial begins as lawyers spar over witnesses, damages

A major trial for Meta, the parent company of Facebook, is set to begin in California on Tuesday. Attorneys from four states have clashed over witnesses and potential financial penalties. The lawsuit was filed by a coalition of states in 2023, with the selected jurisdictions representing them. State attorneys argue that Meta intentionally made Facebook and Instagram addictive for children, violating federal and state laws.

Meta, boasting over three billion users worldwide, attempted to keep key witness Arturo Bejar from testifying, but a federal judge overturned their request. Bejar previously testified against the company, including in a New Mexico trial where Meta lost.

During the trial, state attorneys will question Bejar about Meta's safety and growth practices and whether the company misrepresented its knowledge of these issues. Meta is also challenging the scope of testimony from another potential expert, Colin Gray, who will discuss "dark patterns," features designed to manipulate users. Meta founder and CEO Mark Zuckerberg is among the expected star witnesses.

The states are seeking approximately $200 billion in damages, disputing Meta's claim of $1 trillion as a means of creating shock value. In addition to financial penalties, the states demand changes to Meta's apps. Eight individuals were chosen to form an advisory jury, with the final decision resting with the judge, who is expected to rule by early October.

The trial, which could last six weeks, is seen as a significant step towards holding social media companies accountable for mental health and safety issues, potentially shaping a broader reckoning for Meta.
