ABC sues Trump’s media regulator over demand for TV license renewals

ABC has filed a lawsuit against the Federal Communications Commission (FCC), claiming that the agency is retaliating against the network for its content in a manner that threatens the independence of the press. The network filed the lawsuit after being compelled to apply early for license renewals to broadcast on eight local television stations it owns.

The FCC, currently led by Brendan Carr, is expected to decide whether to approve the renewal requests or hold a hearing on their merits. A coalition of former FCC officials, appointed by both Democratic and Republican presidents, has warned that the agency is attempting to send a "chilling message" to broadcasters following the forced early application for license renewals.

Conservative organizations, such as the Center for American Rights and the Media Research Center, have also filed petitions urging the FCC to deny the renewals, citing the network's perceived political bias. ABC is also currently under an ongoing FCC investigation over the daytime talk show The View for a potential violation of equal time rules.

The lawsuit alleges that the Trump administration has been retaliating against ABC specifically for its content, asserting that the administration has been attacking the network's speech, including the stories its journalists report and the viewpoints its programs air. The lawsuit states that the administration's actions have escalated to the point where it has demanded that ABC be stripped of its broadcast licenses due to its speech.

If the FCC were to deny the renewal requests, the network argues that it would be a "charade," as the FCC cannot, by statute, grant early license renewals. The case poses a threat to the network's survival, with the lawsuit expressing concern that the FCC could either prolong the process or deny the licenses altogether. If left unchecked, the lawsuit argues that the Trump administration could retaliate against any media company it dislikes for editorial and political reasons, with the consequence being that only stories favorable to the administration would be reported, effectively silencing critical voices and rendering the press "free" only in name.

ABC seeks a court injunction to prevent the FCC from taking any further actions against it or threatening any actions. The FCC has stated that all broadcasters have a legal obligation to operate in the public interest, and that it is currently examining claims of illegal discrimination against Disney's ABC stations. The agency is concerned about the ongoing campaign of disinformation and has taken legal action to address the allegations.
