TMA asserts exclusive planning authority in Tema

The Tema Metropolitan Assembly (TMA) has asserted its exclusive authority as the planning and development body for the Tema Metropolis. According to Madam Ebi Bright, the Tema Metropolitan Chief Executive (MCE), all physical developments within the city must adhere to the assembly's planning and permitting procedures. This stance is rooted in Ghana's local governance and planning laws, which assign planning and development authority to Metropolitan, Municipal and District Assemblies (MMDAs).

The clarification comes in response to a dispute between the TMA and TDC Company Limited over an infilling project at Community One Site Three. During a meeting with residents from Sites Three and Eight, Madam Bright explained that the assembly had received petitions concerning developments in these communities, such as the cutting down of approximately 50 trees, the demolition of existing structures, the seizure of playgrounds and green belts, and the obstruction of access. She visited the area and confirmed that some of these activities were indeed occurring.

Although TDC has legitimate responsibilities related to land ownership, property management, and lease administration, these functions do not grant it planning and regulatory authority. TDC can develop its property but must obtain the necessary permits from the TMA before engaging in any physical development. The assembly is responsible for reviewing proposed developments, engaging with affected residents and their elected representatives, considering objections, and, if needed, leading processes for rezoning and obtaining the required approvals.

Madam Bright emphasized that the situation should not be seen as the assembly attempting to undermine TDC. She stressed that TMA respects the company's legitimate commercial and property management functions. The issue, she clarified, is about ensuring that every institution operating in Tema complies with its lawful mandate. TDC's transformation into a private limited liability company in 2017 further distinguishes its property management role from the regulatory functions of the assembly.

While TDC can collect ground rent, manage its properties, and administer leases, it cannot issue building permits, conduct demolitions, rezone public spaces, or issue enforcement notices.

The assembly has also received complaints from residents who have reportedly received conflicting notices from both TMA and TDC. Some structures bearing valid TMA permit numbers have reportedly been demolished by TDC's task force. Madam Bright cautioned against such practices, stating that the assembly would continue to enforce its mandate while working with other institutions to resolve the dispute.
