Ramaphosa's meeting with Perez family exposes government hypocrisy on IDF service

The recent meeting between President Cyril Ramaphosa and the family of the late Captain Daniel Perez has come under intense criticism for exposing the government's hypocrisy regarding its stance on individuals serving in the Israeli Defence Force (IDF). Perez, a South African-born citizen, was a tank commander in the IDF's 7th Armoured Brigade.

His service, however, was wholly illegal under South African law, as per Section 198(b) of the Constitution of the Republic of South Africa, which prohibits South African citizens from participating in armed conflict, be it nationally or internationally, except as provided in the Constitution or national legislation. The Regulation of Foreign Military Assistance Act and the National Conventional Arms Control Committee further require prior authorization for any citizen to render foreign military assistance.

In Perez's case, such authorization was conspicuously absent. Furthermore, Israel has been accused of genocide against the Palestinian people in Gaza, and South Africa has taken Israel before the International Court of Justice for these alleged crimes. This makes serving in the IDF a direct participation in a genocidal apparatus, which not only defies the law but also the principles of justice and morality that the government claims to uphold.

Former Minister of International Relations and Cooperation Naledi Pandor had previously stated that no South African citizen can legally serve in the IDF, and those who do so should face arrest for their illegal actions. Despite this, the South African government facilitated Perez's repatriation to South Africa and extended a personal audience to his family, thus endorsing and legitimizing his illegal service.

This act of state involvement in the repatriation process and the granting of presidential hospitality to Perez's family weakens South Africa's moral and legal standing in its claims against Israel's actions in Gaza. It also sends a dangerous message that South African citizens who serve in the IDF will not face legal consequences, thereby undermining the credibility of South Africa's own case before the International Court of Justice.
