Exclusive: City giants tighten trans policies

Major London financial institutions are being compelled to tighten their inclusion policies after the Equality and Human Rights Commission (EHRC) released fresh directives interpreting a landmark Supreme Court ruling from April. Squares Mile powerhouses such as Admiral, Coventry Building Society, and Santander have updated their human resources procedures to restrict transgender staff and visitors from utilizing single-sex bathrooms, City AM has learned.

This follows the regulator's guidance clarifying how service providers should interpret the court's decision on the definition of sex. The directive stipulates that single-sex spaces like toilets and changing rooms should only be restricted to people of that biological sex unless the facilities are self-contained. It also encourages firms to provide a third or mixed-sex space, provided it does not compromise single-sex provision.

Several financial services firms, including Natwest, Standard Chartered, and Prudential, were previously criticized by Sex Matters, a charity, for not adhering to the early EHRC guidelines. The combination of the Sex Matters report and the new EHRC code has prompted these prominent firms to revise their transgender policies. Admiral has aligned its relevant policies with the legal position, while Coventry Building Society is now offering both single-sex and gender-neutral spaces.

These changes reflect the intricate balance companies must strike in the aftermath of the Supreme Court ruling, which defined a woman as someone who is biologically female and allowed transgender individuals to be excluded from women-only spaces.
