Conservative MP who wants to skip pay raise takes request to court

Ottawa - Conservative MP Mike Dawson is challenging the annual pay raise provided to members of Parliament, despite the House of Commons asserting he is legally obligated to accept the additional funds. First raising the issue in February, Dawson filed a request for judicial review in June, aiming to reject the nearly $8,000 pay increase.

The 35-year-old MP for Miramichi-Grand Lake, N.B., argues that elected officials should exemplify fiscal restraint and solidarity with ordinary Canadians grappling with spiraling living costs. Dawson has received over 20,000 supportive messages from Canadians since February, with several of these letters included in his affidavit.

Under federal legislation, House of Commons Clerk Eric Janse stated that all MPs must receive the salary amounts specified in the law, and deviating from this would be both illegal and impractical. The MP's salary, including annual adjustments, must be paid according to the Parliament of Canada Act. The Speaker of the House of Commons, Olivier Duhaime, anticipates Dawson's submission of a memorandum of fact and law by the end of August or early September, providing the House with 20 days to respond. Duhaime noted that the House will not comment further on the matter while it is under court review.

Dawson's legal counsel, Robert Blakely, stated that this is the first time the issue of MP pay raises has reached court. Blakely explained that Dawson has been donating his raise to charity but would prefer to be able to decline it. Blakely emphasized that the Act outlines a mechanism to determine the pay increase, and no law prohibits an MP from refusing it.

Blakely expressed that his stance is to attract high-caliber, moral politicians with a social conscience and progressive views who are concerned about the country's fiscal state.
