법제 국책연구기관 “임신중지 ‘미프진’ 법개정 전이라도 허가 심사 가능”

The Korean National Research Institute on Legislation, a government research institution, has stated that approval for the abortion pill, Miprin, can still be granted even if there is no specific law governing its use. This perspective comes amidst calls for legislative reform following a Supreme Court decision on the constitutionality of the abortion law.

The Ministry of Food and Drug Safety (KFDA) has been holding the position that Miprin approval has been pending for seven years. However, the Korean Law Institute countered this with a report titled "Legal Framework for Miprin and Women's Health Rights," revealing that "legal approval can only be granted after establishing a defined scope of use."

The report emphasized that "the criteria for approving a drug are safety, efficacy, and quality, determined by the submitted clinical data." It also noted that "as there is no explicit restriction on Miprin approval in the Pharmacy Act, a drug company can submit an approval application to the KFDA, which will then review it and approve it if suitable."
