How Matonya's ailing mother's plea ended his rape trial in Kenyan court

The ailing mother of Tanzanian Bongo Flava star Sefu Shabani Ramadhani, known as Matonya, played a pivotal role in the termination of a rape case against him at the Shanzu Law Courts in Mombasa. According to court records, Matonya's mother directly contacted the woman who had accused her son of rape, requesting forgiveness and urging her to withdraw the charges.

This plea, coupled with the complainant's emotional exhaustion from the case, led to a series of events culminating in the withdrawal of the accusations. The woman, in a sworn affidavit, explained that the case had become an unbearable emotional burden and she chose to forgive Matonya for her own well-being. This decision was further supported by her desire to reconcile with her son and the overwhelming psychological impact the case had on her personal life.

Although rape was alleged, the court found no legal barriers to allowing the application for withdrawal after reviewing the complainant's affidavit and the prosecution's position. The Director of Public Prosecutions did not oppose the request, and the case was officially withdrawn under Section 87(a) of the Criminal Procedure Code, leading to the accused's release.
