[단독] 특검, 윤석열·신원식 기소…‘계엄 정당화’ 메시지 전달 혐의

The Special Investigation Team (SIT) accused former President Yoon Suk-yeol and National Security Secretariat Director Shin Wi-ran of delivering "emergency justification" messages to the US and other allied nations. The SIT determined that the end of the internal emergency was on December 14, 2024, when the State Assembly passed a motion to suspend Yoon's duties.

Consequently, they accused Yoon and Shin of engaging in crucial tasks during the emergency. The SIT also charged Shin with applying for unauthorized use of authority and applying to "use" a crucial emergency task, despite not having the authority. They believe Shin, under Yoon's command, collaborated with Kim Ta-eo, the former head of the National Security Secretariat's first division, to deliver the message to 6 nations including the US, Japan, UK, Australia, New Zealand, and the EU on December 3, 2024.

The SIT maintains that this act was done to justify the emergency, secure legitimacy, and maintain/enforce the emergency state. The SIT also accused both Yoon and Shin of violating their duties by following orders to deliver this message, even though they were not obligated to do so. The previous special investigation team, led by Kim Soo-yeon, argued that the emergency ended on December 4, 2024, based on past cases of former President Park Geun-hye, among other factors.
