Employee wins 7.86L for lunch-break accident

Yashpal, a supervisor at a construction site in Delhi, suffered severe injuries when an iron rod fell on him during his lunch break in 2010. He subsequently filed a claim for compensation, arguing that the accident occurred during his employment. The Delhi Employees Compensation Commissioner ruled in favor of Yashpal, ordering the insurance company to pay Rs 7.86 lakh with 12% interest per annum.

The high court upheld the decision, rejecting the insurer's arguments that Yashpal was not an employee within the meaning of the Employee Compensation Act, 1923, or that the accident was not part of his employment. The court also accepted the medical evidence, confirming that Yashpal had suffered 75% disability due to the amputation of his left leg.
