Bombay HC Allows Amazon Retail India To Destroy Expired Food Stock Under FDA Supervision

Mumbai, August 10, 2026 - The Bombay High Court on Monday allowed Amazon Retail India to catalog and dispose of expired food items at its Bhiwandi warehouse under the Food and Drug Administration's supervision, following a dispute over the cancellation of its food licence. The court's bench, consisting of Acting Chief Justice Ravindra Ghuge and Justice Gautam Ankhad, ordered the company to provide an inventory of the expired goods to an FDA officer for verification within 24 hours.

The expired products will be destroyed in accordance with the FDA's November 3, 2025 advisory. The bench adjourned the matter until August 27, with an affidavit from Amazon due by August 20. The FDA had taken action against Amazon's Bhiwandi warehouse after alleging that expired food products meant for disposal were being sold in the retail market, a claim the company denies.

During the hearing, Government Pleader Neha Bhide stated that the FDA had issued notices regarding improper disposal practices, but Amazon argued that the issue was about expired stock disposal, not overall warehouse functioning. The court had previously criticized the FDA's approach, calling for systematic and procedurally sound actions.
