Guru tampar pelajar diarah bayar ganti rugi RM88,069

A school history teacher in Kelantan, Isamuddin Ismail, has been ordered by the Kota Bharu High Court to pay the full compensation of RM88,069 to a student who was assaulted by him four times in 2019. The assault involved the teacher striking the student's face and both ears with both hands from behind, causing significant injuries.

The victim, Adam Maidin, 21, received compensation through his mother, Noor Azleen Mohamad, 47, after bringing a civil suit against the teacher. The court ruled in favor of the plaintiff, taking into account medical reports and hearing tests that confirmed the student's injuries. The court also found that the teacher, as an educator, had a responsibility to be vigilant towards students.

Three other defendants, including the school principal, head of education, and the government, were represented by a federal barrister, Siti Syakimah Ibrahim. The incident occurred around 10:30 am when the victim was with classmates when the teacher approached from behind and attacked him four times. As a result, the victim suffered injuries to his face and both ears, as well as hearing loss and buzzing in his ears.

The victim was taken to Berek Health Clinic for treatment and then referred to Universiti Sains Malaysia Hospital Kubang Kerian for expert ear examination. A medical report from June 2019 revealed that the student suffered hearing problems in his right ear, including partial hearing loss, which was diagnosed as a trauma-related injury.

The plaintiff's lawyer stated that the RM88,069 compensation ordered by the court included RM45,000 for general damages, RM569 for special damages, RM11,250 for comparative damages, and RM11,250 for aggravated damages, plus interest and legal costs amounting to RM20,000.
