DKU, SUA mohon mencelah kes singkir Yang Dipertuan Besar

The Nine Judicial and Legislative Council (DKU) of Negeri Sembilan has demanded the dismissal of a challenge to the appointment of Tuanku Muhriz as Yang Dipertuan Besar. They submitted a request on August 6th, asking for the inclusion of DKU and co-respondents – Raja Norazli, Raja Nordin, and two additional individuals, to consider submitting their full cause of action.

The first two respondents are the Chief Minister of Negeri Sembilan and the state government. DKU also seeks a stay on the dismissal proceedings until the petition for cancellation is resolved. They claim they have a direct interest in the matter, as Tuanku Muhriz is the chairperson of DKU, and any attempt to dismiss could directly impact the council's administration, jurisdiction, and functions.

They argue the dismissal notice issued on March 5th should have been filed within three months, before or on June 5th, under Rule 53 of the 2012 Court Processes. The cancellation of the dismissal was recorded in a DKU official statement dated August 1st. The court also notes that three petitioners are no longer Undang holders, while the fourth was never legally appointed as Undang Rembau due to incomplete nomination procedures.

The petitioners failed to present material facts, including the initial complaint filed with the High Court, a temporary restraining order issued against them on June 5th, and a committal hearing resulting from a contempt of court charge. They should have received freedom from contempt charges before pursuing any other legal action, even though a temporary stay granted by the Court of Appeal remained in effect.

DKU argues the dismissal notice is not legally valid as it allegedly was made without full and proper consideration, without notifying Tuanku Muhriz, and without giving him a chance to defend himself. It states there was no declaration of the signatures of the Chief Minister and Chief Minister, as required under Section 10(2) of the State Government Corporation Act, which never appeared.

The petition was supported by affidavits sworn by Raja Norazli, Faris Johari, who replaces Mubarak Dohak, and Hassan Ab Hamid, along with DKU and Raja Norazli. They were represented by attorneys Khairul Azam Abdul Aziz, David Dinesh Mathew, Shafril Halim, Shaikh Saleem Karim, and Robert Low and Hafidz Yusoff.
