Court stops Club 213 from playing music after noise complaints

The Milimani Environment and Land Court recently issued interim orders barring entertainment venue 213 Lounge and Restaurant from playing music within its premises, to prevent disturbance to nearby residents. The decision came after a resident, Allan Monroe Onyango, filed a petition on Monday, August 3rd, accusing the club of playing loud music from around midday until the early hours of the morning.

Onyango's concerns centered around the club's noise causing traffic congestion, overcrowding on pedestrian pathways, and obstructing smooth movement for residents in the surrounding area.

Onyango accused Nairobi City County and the National Environment Management Authority (NEMA) of issuing unlawful permits to the club, which he believed caused public disorder and indecent acts. He further claimed that both the county government and NEMA had failed to enforce compliance with the conditions of the club's license, allowing it to operate in a residential area.

The court has given Nairobi County and NEMA seven days to inspect the premises and submit a report on whether they are complying with Environmental Management and Coordination Act (EMCA) regulations on excessive noise. Both parties have been given an additional seven days to file and serve their submissions, with a mention date set for Thursday.

The case has been brought to light as Nairobi residents continue to voice their concerns about clubs operating in residential areas, which they claim contribute to crime, noise pollution, and hinder development.
