AIBE must within 2 years for law graduates post-2009 to practice: Allahabad High Court

Allahabad High Court has ruled that law graduates from the 2009-10 academic session must take the All India Bar Examination (AIBE) within two years of provisional enrolment to continue practicing in any court, tribunal, or revenue court. The court clarified that merely holding an enrollment certificate from a State Bar Council is not sufficient to retain the Right to practice after two years.

Justice Arun Kumar Singh Deshwal made the decision while determining whether law graduates failing to clear AIBE within two years would still be permitted to appear in court. The requirement stems from the All India Bar Examination Rules, 2010, which mandates the examination for law students graduating in or after 2009. The court emphasized that the restriction applies to all courts, including revenue courts, and that advocates failing to pass the AIBE within two years will be barred from practicing until they do so.

The High Court also clarified that advocates with provisional enrolment must be on the Allahabad High Court's provisional advocate roll to practice before it.
