Karachi Red Line Contract Termination Declared Unlawful

The Dispute Resolution Board has deemed the Sindh government's termination of the Karachi BRT Red Line project's Lot 2 construction contract as unlawful and invalid. This decision came after the Sindh High Court compelled the government and contractor AM Associate to settle their dispute through the board as stipulated by their contract.

The Sindh government had terminated the Lot 2 contract, which spans the Mosamiyat to Numaish section, citing a lack of progress. However, AM Associate contested this termination in the Sindh High Court, alleging that the provincial government had delayed the project. Following more than two months of hearings, the Dispute Resolution Board found that the Sindh government had ended the contract prematurely without properly considering alternative measures.

The board also raised significant concerns regarding TransKarachi's ability to manage the project, noting that the implementing agency lacked the necessary institutional capacity and project management skills for such a large and complex initiative. The board pointed out that TransKarachi had failed to meet several crucial contractual obligations, including not finalizing the design, providing the contractor with a clear project site, and making substantial outstanding payments.

These issues severely impacted the contractor's ability to execute the work and contributed to project delays. Furthermore, the board criticized repeated design changes, poor coordination, delayed decisions, and ineffective contract administration. The board concluded that the termination was premature and not a reasonable last resort.
