Five US work visa categories for foreign nationals

The United States issues around 140,000 employment-based immigrant visas annually, creating opportunities for foreign nationals with specialized skills, professional qualifications, and investment capacity. These visas are categorized into five preference groups, each designed to attract a distinct type of talent. Spouses and children of approved applicants can also benefit by accompanying or joining their principal beneficiaries after approval.

Category one, known as EB-1, is for priority workers and individuals with extraordinary ability in various fields such as science, arts, education, business, and athletics. This category offers a direct path to permanent residence for those who can prove their extraordinary talent without requiring a job offer. Another notable group is EB-2, which caters to professionals with advanced degrees and individuals with exceptional ability in scientific, artistic, or business domains.

Unlike EB-1, applicants in this category often need a job offer and a labor certification, although there is an exception through the National Interest Waiver that allows for self-petitioning.

The third category, EB-3, encompasses skilled workers, professionals, and other workers. Skilled workers must demonstrate at least two years of training or equivalent work experience, while professionals generally need a bachelor’s degree or its foreign equivalent. Finally, the EB-4 category is reserved for certain special immigrants, including religious workers, broadcasters, Iraqi and Afghan interpreters, former US government employees, and individuals serving in the US Armed Forces.

As the last category, EB-5 targets foreign investors who make significant capital investments in new commercial enterprises in the United States, aiming to create jobs for US workers.
